Introduction to the Istanbul Protocol

Abstract

The Istanbul Protocol is a manual that offers guidelines for the investigation and documentation of cases of torture and other cruel, inhuman, or degrading treatment (CIT/CrID). Although it is not a legal document, it is a fundamental tool for specialists in various disciplines involved in the investigation of these crimes. The protocol establishes international standards and details the necessary elements for the investigation, such as the collection of physical and psychological evidence and the testimony of victims. At the international level, there are several legal instruments that prohibit torture, such as the International Covenant on Civil and Political Rights and the Convention against Torture. At the national level, in Mexico, the General Law to Prevent, Investigate, and Punish Torture establishes a criminal definition of torture. The use of the Istanbul Protocol is recommended, but not mandatory; however, the absence of a report based on it should not be grounds for closing an investigation.

She holds a PhD in Conflict Management and Resolution, Minors, Family, and Therapeutic Justice from the University of Vigo. She is a full-time professor at the UNAM School of Law. She is a member of the National System of Researchers (CONAHCYT), Level 1.
