Sobre la legitimidad y la paradoja del derecho

Abstract

The author approaches the subject of the legitimacy of the right in the light of the theory of the systems and the theory of the communicative action. The relation between “the collective” concept and the legal construction of “majority” is analyzed from an ethics of the speech that allows to understand the paradox of the right like instrument and obstacle of the collective aspirations.
