Luhmann, Jakobs y el derecho penal del enemigo

Abstract

The author takes up again the topic of the Criminal law of the enemy starting from postulates of Günther Jakobs and Niklas Luhmann, dealing with several concepts of the social systems theory, to arrive at the penal funcionalism and that way to do a critic to the posture of Jakobs with regard to the Criminal law of the enemy.
