Resumen

En el presente artículo se reflexiona en torno al derecho del trabajo toando como punto de partida la función protectora de la relación  que tiene el mismo en cuanto al trabajo, máxime si se consideran las fuerzas de producción. El análisis revisa la subordinación desde los fenómenos actuales: el mercado laboral como la gigeconomy y los empleos atípicos.Asimismo se estudia la tendencia a la desregulación como un factor importante, sosteniendo que los fenómenos que se examinan no degradan el valor de la subordinación como criterio de determinación de la relación de trabajo.

Especialista en Derecho del Trabajo en la Unidad de Derecho Laboral y Reforma del Departamento de Gobernanza y Tripartismo de la Organización Internacional del Trabajo (Ginebra, Suiza). Investigador de la Facultad de Derecho de la Pontificia Universidad Católica de Valparaíso (Chile). Ha sido profesor de las Cátedras de Derecho del Trabajo y de Seguridad Social en la Pontificia Universidad Católica de Valparaíso (Chile).
