Judicial Modernization, Management and Administration in Latin America

Abstract

The article deals with the situation of the Latin American judiciary in a scenario of constant change. From a systemic approach, it analyzes judicial modernization in countries of the region and identifies two streams: one based on management training to improve existing models, another one focused on the implementation of new models based on the separation of judicial and administrative activities. It concludes that the first modernization stream can motivate agents to participate in deeper reforms as those ones promoted by the second stream. It reproduces interviews to key informants, qualitative and quantitative data on implemented reforms.
